General Terms and Conditions Bildungshaus St. Jodern
Basis
These General Terms and Conditions govern the legal relationship between our guests and us, the Bildungshaus St. Jodern. The reservation or order confirmation, which will be sent to you by e-mail or post, serves as the basis. The contractual partners are the Bildungshaus St. Jodern and the customer/guest. If a third party has ordered on behalf of the customer/guest, they are liable to the hotel together with the customer/guest as joint and several debtors for all obligations arising from the hotel accommodation contract, provided that the hotel has a corresponding declaration from the third party. The subletting or other transfer of the rented rooms to third parties as well as their use for purposes other than accommodation require the prior written consent of Bildungshaus St. Jodern. The guest as contractual partner must exercise his rights and obligations in accordance with the house rules.
Offers and provisional bookings
option dates are binding for both parties. If the guest does not return a written order confirmation before the expiry of the option date, the rooms and spaces will be released for sale again.
Definitive bookings
All bookings are confirmed in writing by Bildungshaus St. Jodern. If you do not receive a confirmation by e-mail or post within a reasonable period of time, please contact us.
Prices
Prices are quoted in CHF and include statutory value added tax. Any increase in VAT after conclusion of the contract shall be borne by the client. All published prices can be adjusted at any time. The prices communicated in writing by the Bildungshaus St. Jodern are valid. The visitor’s tax of CHF 1.50 is included in the price and is shown separately on the invoice.
Collection
For room bookings of 1-5 rooms, the stay is paid directly on arrival by cash, debit or credit card. For groups with bookings of more than 5 rooms, we will send the invoice for the stay after the cancellation deadline, which must be paid before arrival. In the case of foreign payments, the charges are borne by the customer. We charge an additional fee of CHF 20.00 for foreign bank transfers. In the event of late payment, Bildungshaus St. Jodern is entitled to charge interest on arrears and reminder fees.
Cancellation by the customer
For room bookings of 1-5 rooms, the room can be canceled free of charge up to 24 hours before arrival. Cancellation must be made in writing via e-mail to info@stjodern.ch. In the event of a late cancellation, no-show or early departure, the total amount will be charged. For bookings of several rooms, events or rooms, the cancellation conditions stated on the booking confirmation apply. In the case of an online booking with an incorrect/invalid credit card number, we consider the booking as not guaranteed and will cancel it.
Withdrawal of the hotel
The Bildungshaus St. Jodern is entitled to withdraw from the contract extraordinarily for objectively justified reasons, for example if force majeure or other circumstances for which the Bildungshaus St. Jodern is not responsible make the fulfillment of the contract impossible; hotel services are booked with misleading or false information about material facts, e.g. in the person of the customer or the purpose; the Bildungshaus St. Jodern has reasonable grounds to believe that the use of the hotel services would jeopardize the smooth running of the business, the security or the purpose of the hotel.Bildungshaus St. Jodern has justified cause to believe that the use of the hotel services may jeopardize the smooth running of the business, the security or the reputation of the hotel in public, without this being attributable to the hotel’s sphere of control or organization. The Bildungshaus St. Jodern must inform the customer of the exercise of the right of withdrawal without delay.
Check-in hotel rooms
Booked rooms are available to the customer from 2 p.m. on the agreed day of arrival. The customer is not entitled to earlier availability. Arrivals after 8.00 p.m. must be notified in advance.
Check-out hotel room
The booked room must be checked out by 10.00 a.m. at the latest on the day of departure. After this time, Bildungshaus St. Jodern may charge 100% of the full accommodation price (list price) for the additional use of the room in addition to any damages incurred.
Liability of the guest
The guest is liable for damage or loss to facilities or inventory that occurs during a stay or during an event, without the need for proof of fault on the part of the hotel. Any costs incurred will be charged to the guest. The Bildungshaus St. Jodern accepts no liability for theft or damage to items brought into the hotel. This is the responsibility of the guest in all cases.
Smoking ban and fire safety
1. The use of kettles, ovens, toasters, immersion heaters, electric irons and similar appliances is prohibited. The use of the kettles provided for heating liquids other than water is prohibited.
2. if an attempt is made to willfully disable the fire alarms, a penalty fee of at least CHF 500 per room will be charged. In addition, the guest will be charged for all other consequential costs incurred.
3. in accordance with Art. 3 para. 1 let. c of the law on the protection of non-smokers and the advertising of tobacco products of December 13, 2007, smoking is prohibited inside the hotel (smoking out of the window is also prohibited).
4. if the fire department is alerted in error or improperly, a fee of at least CHF 500.00 plus the fire department’s deployment costs will be passed on to the person responsible.
Events
In order for events and seminars to run smoothly, the Bildungshaus St. Jodern requires the correct number of participants 10 days before the event. This number of participants is binding and will be invoiced. If the number of participants deviates upwards, the actual number of participants will be invoiced.
Media
Advertisements in the media with reference to an event at the Bildungshaus St. Jodern require the prior written consent of the hotel. Videos, interviews or other contributions recorded in the Bildungshaus St. Jodern that wish to be published in the media require the prior written consent of the hotel. If a publication is made without consent and the interests of the hotel are impaired as a result, the Bildungshaus St. Jodern has the right to cancel the event subject to a claim for remuneration and any claims for damages.
Liability of the hotel
The Bildungshaus St. Jodern is liable for its obligations arising from the hotel accommodation contract with the diligence of a prudent businessman. Claims of the customer for damages are excluded.
The hotel room must be used by the customer with the utmost care. The customer or the company must pay for any damage to property. The Bildungshaus St. Jodern rejects any liability for theft etc. and in relation to third-party services.
If the customer is provided with a parking space, this does not constitute a safekeeping agreement. The hotel is not liable for loss of or damage to motor vehicles parked or maneuvered on the property of the Bildungshaus St. Jodern and their contents.
Lost property
Lost property will only be forwarded at the guest’s request. The guest bears the costs and risk of forwarding. Lost property will be kept for 1 year, after which it will be disposed of.
Applicable law / place of jurisdiction
The General Terms and Conditions (GTC) are an integral part of our definitive confirmation. The place of performance and jurisdiction for both parties is Visp. The GTC govern the legal relationship between the guest/organizer and the Bildungshaus St. Jodern. Any deviating agreements or subsidiary agreements must be set out in writing.
